HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. Our Duty to Safeguard Your Health Information
Rachael Courtier Psychotherapy and Coaching, operated by Rachael Courtier, LCSW (California LCSW License #65691), is committed to protecting the privacy of your health information. We are required by law to maintain the privacy of Protected Health Information (PHI), provide you with this Notice, and abide by the terms currently in effect.
2. How We May Use and Disclose Your Health Information
Treatment
We may use and disclose your PHI to provide, coordinate, or manage your mental health treatment and related services, including sharing information with other providers involved in your care.
Payment
We may use and disclose your PHI to obtain payment for services, including submitting claims to your health insurance or billing you directly.
Healthcare Operations
We may use and disclose your PHI for internal operations including quality improvement, training, licensing, and administrative purposes.
3. Other Permitted or Required Disclosures
We may disclose your PHI without your authorization in the following circumstances:
Mandatory reporting of child abuse or neglect (California Penal Code §11164)
Mandatory reporting of elder or dependent adult abuse (California Welfare & Institutions Code §15630)
Duty to warn or protect an identifiable third party from serious and imminent threat (Tarasoff duty, California Civil Code §43.92)
When required by court order, subpoena, or other legal process
As required by federal, state, or local law
To avert a serious threat to health or safety
For public health activities as required by law
4. Your Rights Regarding Your Health Information
Right to Access
You have the right to inspect and obtain a copy of your PHI. Requests must be submitted in writing. We may charge a reasonable fee for copies.
Right to Request Amendment
You may request amendment of your PHI if you believe it is incorrect or incomplete. We may deny your request under certain circumstances.
Right to an Accounting of Disclosures
You have the right to request a list of disclosures we have made of your PHI, other than those for treatment, payment, or healthcare operations.
Right to Request Restrictions
You may request restrictions on certain uses or disclosures of your PHI. We are not required to agree, but if we do, we will honor the restriction.
Right to Confidential Communications
You may request that we communicate with you about your PHI in a specific way or at a specific location.
Right to a Paper Copy
You have the right to receive a paper copy of this Notice upon request, even if you agreed to receive it electronically.
5. Telehealth Services
Rachael Courtier Psychotherapy and Coaching provides services exclusively via telehealth to clients located in California. We use HIPAA-compliant platforms and your PHI transmitted electronically is subject to the same protections described in this Notice.
6. Changes to This Notice
We reserve the right to change this Notice at any time. Any revised Notice will be effective for all PHI we maintain. The current Notice is always available at rachaelcourtier.com.
7. Complaints
If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services (HHS). We will not retaliate against you for filing a complaint.
